What is a Fire Safety Certificate?
A Fire Safety Certificate is a certificate issued by the Building Control Authority which states that the works or building to which the application relates will, if constructed in accordance with the plans and specifications submitted, comply with the requirements of Part B of the Second Schedule to the Building Regulations 1997 (as amended). https://www.gov.ie/en/publication/1d2af-building-regulations/
What are the different types of Fire Safety Certificate Applications and which type do I need to apply for?
- A Fire Safety Certificate Application is required for proposed works in connection with the design and construction of a new building, extensions to, material alterations of, or material change of use to buildings where a fire safety certificate is required in accordance with Part III of the Building Control Regulations (as amended) https://revisedacts.lawreform.ie/eli/1997/si/496/front/revised/en/html
- A Revised Fire Safety Certificate Application is required for works where a significant revision is being made to the design or works of a building, an extension of, material alteration to or material change of use of a building which has already been granted a fire safety certificate or where revision is made to the design arising from the grant of planning or conditions attached to it.
- A 7 Day Notice Application is submitted where works are proposed to begin prior to the grant of the relevant Fire Safety Certificate. A 7 day notice shall be submitted not less than 7 days prior to the commencement of works and must be accompanied by a valid Fire Safety Certificate Application. A 7 day notice application also requires statutory declarations, certificates and notices as set out in Section 20A of the Building Control Regulations 1997 (as amended).
- A Regularisation Certificate Application applies to the works that have already been commenced or completed in the absence of obtaining a fire safety certificate or the submission of a 7 Day Notice, if required by the Building Control Regulations 1997 (as amended) prior to the commencement of the works. The application also requires statutory declarations to be submitted as outlined in Section 20C of the Building Control Regulations 1997 (as amended). The application requires the competent person to demonstrate how the building as commenced or completed has been constructed or is being constructed to demonstrate compliance with the Building Regulations. This shall usually involve submitting additional certificates for materials, products or systems installed within the building.
