Compulsory Purchase Order - Stranorlar Multi-Use Sports Facility

‌FORM OF NOTICE OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960, TO BE PUBLISHED IN ACCORDANCE WITH ARTICLE 4(a) OF THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS AMENDED BY THE PLANNING AND DEVELOPMENT  ACTS, 2000-2021

 

COMPULSORY  ACQUISITION OF LAND

 

DONEGAL COUNTY COUNCIL (STRANORLAR MULTI USE SPORTS FACILITY IMPROVEMENT PROJECT) COMPULSORY PURCHASE ORDER 2022

 

1. Donegal County Council (hereinafter referred to as "the Local Authority") in exercise of the powers conferred upon them by Section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by Section 10 of the Local Government (No. 2) Act 1960 as substituted by Section 86 of the Housing Act, 1966 as amended by Section 6 of and the Second Schedule to the Roads Act, 1993 and as amended by the Planning and Development Acts 2000- 2021 have made an order entitled as above which is about to be submitted to An Bord Pleanala for confirmation. If confirmed, the Order will authorise the Local Authority, to acquire:-

 

(a)     Compulsorily and permanently the land described in Part 1 of the Schedule hereto,

 

(b)     Compulsorily and temporarily the land described in Part 2 of the Schedule and

 

(c)     Compulsorily and permanently a wayleave for electricity connection over/under the lands described in Part 3 of the Schedule

 

for the purposes of the carrying out and delivery of the Stranorlar Multi Use Sports Facility Improvement Project and all associated works involved in same and also for the assembly of a site for the establishment of leisure and other community facilities and in particular the replacement of such facilities displaced by the development of the synthetic Multi Sport All Weather Pitch provided as part of the said project which lands in said Part 1 of the Schedule are shown edged red and coloured grey and the lands in Parts 2 and 3 of the Schedule are shown edged red and coloured purple on the Map marked drawing No. 2016003/09/000 and sealed with the seal of the Local Authority and deposited at the offices of the Local Authority at:-

2. Owners, lessees and occupiers of the land described in the Schedule will receive individual written notice.

 

3. Prior to decision on confirmation or otherwise of a Compulsory Purchase Order, An Bord Pleanala may at its absolute discretion hold an oral hearing in relation to the matter.

 

4. A copy of the order and of the deposited Map referred to in it may be seen during normal office hours (Monday to Thursday from 9.00am to 12.45pm and 1.15pm to 5:00pm and on Fridays from 9.00am to 12.30pm and 1.00pm to 4.30pm) at the offices of the Local authority at:

5.    A Natura Impact Statement, for which separate public Notice has been given , has been prepared in respect of the development which it is proposed to carry out on the land . Evidence in relation to the implications of the    proposed development for the proper planning and sustainable development in the area concerned, the likely effects on the environment of the proposed development and the likely significant effects of the proposed                    development on a European site may be heard at the oral hearing, if any.
